Important Legal Notice: Non-Binding Preliminary Valuations

All valuations, loan-to-value calculations, and initial estimates generated through this website, estimate calculators, or preliminary email exchanges represent non-binding indicative figures only. Formal credit approval and legally binding loan obligations occur solely upon physical in-vault inspection and execution of a formal Loan Agreement and Security Promissory Note.

01

Agreement to Terms & Platform Scope

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Borrower,” or “Client”) and Vaultmark Lending LLC (“Vaultmark,” “we,” “us,” or “our”), governing your access to and use of vaultmarklending.com, including all subdomains, digital estimate forms, calculators, and communications.

By accessing the website, requesting an online estimate, or communicating with our appraisal desk, you confirm that you are at least 18 years of age and possess the legal capacity to enter into binding agreements. If you do not agree to these Terms, you must immediately discontinue use of this platform.

02

Preliminary Online Estimates Non-Binding

Our online estimate tool allows users to submit asset details, reference numbers, and photographs for preliminary appraisal. You acknowledge and agree that:

  • Indicative Nature: All preliminary loan figures, maximum capital ranges ($5,000 to $5,000,000+), and indicative monthly interest rates are estimates based exclusively on user-provided descriptions and secondary wholesale trading indices.
  • No Offer of Credit: An online estimate does not constitute a commitment to lend, a loan offer, or a guarantee of valuation.
  • Physical Verification Prerequisite: A binding loan agreement is issued solely after our credentialed GIA gemologists and master horologists physically authenticate the collateral, verify movement timing, test metal composition via XRF spectrometry, and confirm serial numbers against title registries.
03

Collateral Ownership & Title Warranties

Whenever you submit an asset for appraisal or pledge collateral to Vaultmark Lending, you expressly represent and warrant that:

Sole Legal Title

You are the lawful, sole owner of the asset and hold absolute unencumbered title, free and clear of all liens, mortgages, pledges, legal encumbrances, or third-party claims.

Clean Provenance

The collateral is not stolen, converted, or obtained through fraudulent or illegal means. All items are screened against the Watch Register, Art Loss Register, and law enforcement registries.

Authenticity Guarantee

To the best of your knowledge, the item is authentic, original, and not counterfeit, cloned, or adulterated with aftermarket or non-original parts (unless disclosed in writing).

Authority to Pledge

You have full power and legal authority to pledge the collateral as security under our standard Loan Agreement and Security Promissory Note.

04

Physical Custody, Transit & Insurance

Security and custody of client assets adhere to strict institutional protocols:

  • Armored Transit: Shipping is conducted exclusively using Vaultmark-generated armored courier labels (Brink's, Malca-Amit, or priority express). Packages are covered up to 100% of fair market replacement value under our Lloyd's of London master policy.
  • Depository Storage: Upon intake authentication, items are sealed in serialized tamper-evident security containers and transferred to Underwriters Laboratories (UL) Class 3 high-security depository vaults.
  • Zero Commercial Handling: Items are never displayed, worn, leased, or exhibited. They remain locked under 24/7 dual-custody surveillance until redemption or contractual liquidation.
05

Non-Recourse Structure & Settlement

Every loan disbursed by Vaultmark Lending is strictly non-recourse:

Contractual Borrower Safeguards:

  • Recourse Limitation: The borrower has zero personal liability for the debt beyond the pledged asset. Vaultmark cannot seek personal judgments, wage garnishment, or liens against other assets.
  • Default Remedy: In the event of default or non-redemption, Vaultmark's sole remedy is the lawful liquidation of the pledged collateral.
  • Surplus Value Return Guarantee: If the net proceeds from liquidation exceed the outstanding principal balance, accrued interest, and direct disposal expenses, the excess funds are contractually returned to the borrower.
06
